THE BIKE ATRIUM — TERMS & CONDITIONS

These Terms & Conditions (“Terms”) apply to all purchases from The Bike Atrium Pte Ltd (“we”, “us”, “our”), whether made in-store, on our website, or through online platforms including but not limited to Shopee, Lazada, TikTok, Amazon, Decathlon, and any other authorised distribution channels. These Terms also apply to any person who uses or operates a product purchased from The Bike Atrium, regardless of whether that person is the original purchaser.

By purchasing or using our products, you agree to be bound by these Terms.

1. Information About Us

thebikeatrium.com is a site operated by The Bike Atrium Pte Ltd, registered in Singapore under Business Registration Number 202029410D, located at 11 Woodlands Close #04-45, Singapore 737853.

2. Service Availability

2.1 Our goods and services are intended for customers residing in Singapore. Orders from outside Singapore are not accepted unless otherwise stated.

3. Your Status

By placing using our product, you warrant that:

  • 3.1.1 You are legally capable of entering into a binding contract;
  • 3.1.2 You are purchasing within Singapore.

4. Formation of Contract

4.1 An order acknowledgement does not constitute acceptance. The contract is formed only upon delivery or collection of the product.

  • 4.2 Stock may vary by batch. If unavailable, we will offer alternatives or a refund less administrative fees.
  • 4.3 All online orders will be fulfilled within 7 business days unless otherwise advised.
  • 4.4 Full payment is required upon checkout.
  • 4.5 Product colours, performance, and aesthetics may vary slightly between batches.

5. Our Status

5.1 We may include links to external websites. We are not responsible for the content or product quality of external sellers.

6. Price & Payment

  • 6.1 Prices are as listed unless incorrect due to error.
  • 6.2 If the actual price is lower, we will charge the lower price. If higher, we may contact you for confirmation or reject the order.
  • 6.3 We are not obliged to honour an obviously incorrect price.
  • 6.4 Pre-order fees and purchase payments are non-refundable if you choose not to proceed.

7. Limited Warranty for Bicycles

7.1 Bicycle parts warranty: 6–12 months depending on model (excludes outer tyres, inner tubes, spokes, brake pads).

7.2 Frame warranty: 1–5 years depending on model.

7.3 Warranty covers manufacturing defects only. It does not cover:

  • wear and tear
  • accidents, impacts, falls, or collisions
  • improper or insufficient maintenance
  • negligence or misuse
  • corrosion, water damage, improper storage or washing
  • modifications or tampering
  • external damage

7.4 If parts are discontinued, we may replace them with equivalent alternatives.

8. Warranty Advisory

8.1 Transportation costs for warranty, service, repair, inspection, or return are fully borne by the customer.

8.2 We are not responsible for delivery damage beyond our control.

8.3 We strongly encourage self-collection to ensure the bicycle is within your satisfactory level.

9. Refunds Policy

  • 9.1 Returned products will be inspected before replacement or refund (minus the administrative fees & transportation fees).
  • 9.2 Manufacturing defects may be refunded within the seven-day cooling-off period (delivery fees and administrative fees apply).
  • 9.3 Quantity discrepancies must be reported within 24 hours upon receiving the bicycle.
  • 9.4 Return transportation costs are borne by the customer, this apply to in-store, online and platform purchases and overwrites the platform's return policy.

10. Safety, Usage, and Maintenance Requirements

10.1 Bicycles require regular maintenance. We strongly recommend:

  • General servicing every 2–3 months, depending on riding frequency
  • Immediate attention to unusual noises, looseness, or wobbling
  • Ensuring all bolts, knobs, folding mechanisms, and quick-releases are properly tightened before each ride
  • Ensure tyre is in good working condition and inflated to the recommended PSI range before each ride

10.2 Folding bicycles require proper tightening of hinges, knobs, quick-release mechanisms, and latches before use.

Note: Some of the models do not have a secondary locking mechanism. Proper tightening of the main hinge is essential and required.

10.3 Tyre performance varies based on riding conditions. Wet or slippery surfaces naturally reduce grip. Riders must adjust speed, braking, and cornering angle accordingly.

Service & Transport: All servicing, repairs, inspections, and warranty evaluations are strictly on a carry-in basis at our workshop. We do not provide on-site servicing, home visits, pickup, or collection services. Transportation for returns or servicing must be arranged and paid for by the customer.

11. Assumption of Risk (Critical Clause)

By purchasing, riding, or using our bicycles, you acknowledge and accept that cycling inherently involves risks, including but not limited to:

  • falls
  • collisions
  • slipping on wet or uneven terrain
  • mechanical loosening from road vibration
  • user error
  • environmental hazards
  • loss of control
  • injuries, fractures, or severe harm
  • death

These risks cannot be entirely eliminated even with proper maintenance. By using the bicycle, you agree that you voluntarily assume all such risks.

12. Limitation of Liability (Critical Clause)

12.1 Our liability is strictly limited to the purchase price of the bicycle.

12.2 Under no circumstances shall The Bike Atrium Pte Ltd be liable for:

  • personal injury
  • accidents, falls, or loss of control
  • medical costs
  • property damage
  • third-party claims
  • loss of use or income
  • indirect, incidental, or consequential damages
  • death or severe injury arising from bicycle use

12.3 This applies even if you claim:

  • you did not read the Terms & Conditions
  • the bicycle was used by someone else
  • the bicycle was used under wet, uneven, or hazardous conditions
  • improper or insufficient tightening of folding mechanisms
  • lack of maintenance
  • user error or oversight

12.4 If a manufacturing defect is proven, our maximum liability is limited to: repair, replacement, or refund of the bicycle (capped at its purchase price).

13. Indemnity Clause (Critical Clause)

By purchasing or using our products, you agree to fully indemnify, defend, and hold harmless The Bike Atrium Pte Ltd from any and all:

  • claims
  • demands
  • injuries
  • damages
  • losses
  • legal actions
  • third-party claims
  • medical or financial liabilities

arising from the use, misuse, handling, operation, transport, modification, or maintenance of the bicycle, whether by you or any other person.

This indemnity remains effective even if:

  • the user did not read these Terms
  • the product was purchased through a third-party platform
  • the bicycle was loaned or transferred to someone else

14. Accuracy of Materials

Information on our website may contain errors. We may update materials without notice.

15. Links

We are not responsible for the contents of any external websites linked from ours.

16. Modifications

We may revise these Terms at any time. Continued use of our site or products constitutes acceptance of the current Terms.

17. Events Outside Our Control (Force Majeure)

We are not liable for delays or failures caused by events outside our reasonable control.

18. Severability

If any clause is found unenforceable, the remainder of the terms remains valid.

19. Entire Agreement

These Terms constitute the full agreement and override any prior verbal or written statements.

20. Law and Jurisdiction

Contracts and disputes are governed by the laws of Singapore.
